CIRCULATE GUARANTEE

This Circulate Guarantee ("Guarantee") is a legal policy between you, the customer, and [Rhubarb Store] ("Company") regarding the Circulate program. By participating in the Circulate program, you agree to the terms and conditions set forth in this Guarantee.

Eligibility

In order to participate in the Circulate program and receive the benefits of this Guarantee, you must have purchased an item from our website and have the order number associated with that purchase. 

Process

To participate in the Circulate program, you must email us with your order number and pictures of your item, along with any details on any faults. We will evaluate the item and provide you with a quote for how much we can pay or provide credit for the item back for. If you accept the quote, you must ship the item back to us. Once we receive the item, we will evaluate its condition and verify that the item matches the description and pictures you provided. If the item matches the description, we will confirm the quote and pay you the agreed upon amount in cash or store credit. If the item does not match the description, we will provide a new buy-back price.

Evaluation

We reserve the right to evaluate the item and determine its value based on its condition. We may adjust the buy-back price or refuse to accept the item if we determine that the condition of the item does not match the description you provided. We also reserve the right to refuse to accept an item for any reason.

Cleaning and Mending

If we accept the item, we will clean and mend it as needed to make it ready for the next customer. We will then post it back on our website for sale. By participating in the Circulate program, you agree that we may use the item for this purpose.

Disclaimer of Warranties

The Circulate program is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the Circulate program or the information, content, materials, or products included in the program. You expressly agree that your participation in the Circulate program is at your sole risk.

Limitation of Liability

To the full extent permissible by applicable law, we disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. We will not be liable for any damages of any kind arising from the use of the Circulate program, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages.

Governing Law

This Guarantee shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is located, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to this Guarantee shall be filed only in the state or federal courts located in the jurisdiction in which the Company is located, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.

Entire Agreement

This Guarantee constitutes the entire agreement between you and the Company regarding the Circulate program. Any other agreements, understandings, or representations regarding the program are superseded by this Guarantee.

By participating in the Circulate program, you agree to the terms and conditions set forth in this Guarantee. If you do not agree to these terms and conditions, you may not participate in the Circulate program.
